General provisions

1.1. These rules for the purchase and sale of goods (hereinafter referred to as the Rules) are a legal document binding on the Parties, which establishes the rights, obligations and responsibilities of the Buyer and Seller to the Buyer when purchasing goods in e-shop.

1.2. The seller reserves the right to modify, amend or supplement the rules at any time, taking into account the legal requirements. The buyer is informed by e-shop website. The Shop Rules are applicable at the time of placing the order.

1.3. To purchase at this e-shop are able with the right:

1.3.1. physical persons, i.e., persons who have reached the age of majority, whose capacity is not restricted by law;

1.3.2. minors aged between 14 and 18, only with the consent of parents or care takers, except when they are self-disposing of their income;

1.3.2. legal entities;

1.3.3. authorized representatives of all the above mentioned persons.

1.4. The seller, also approving the rules, also guarantees that, in accordance with Rule 1.3., the Buyer has the right to purchase goods in e-shop.

1.5. The agreement between the Buyer and the Seller shall be deemed to be concluded from the moment when the Buyer has created the shopping cart in the shop, having indicated the delivery address, choosing a payment method and familiar with Seller's rules, clicks on the button "Confirm order".

1.6. Each contract concluded between Buyer and Seller is protected in e-shop.

2. Protection of personal data

2.1. Buyer ordering goods must indicate the Customer's personal data necessary for the proper execution of the order of the goods: name, surname, delivery address, telephone number and valid email address.

2.2. Buyer is responsible for submitting the correct data at the time of purchase.

2.3. By confirming the order, Customer agrees that Customer’s personal data is processed by the seller of the goods for the purpose of the order execution, the Buyer also agrees that given e-mail and phone number will be used to send information necessary for the order execution.

2.4. The customer's personal data may only be processed for marketing purposes if the Buyer himself expresses his consent.

2.5. The Seller undertakes to process the Buyer's personal data in accordance with the laws relating to the processing of personal data.

2.6. The Seller undertakes to process the Buyer's personal data in strict compliance with legal requirements ensuring the legality of the processing of personal data.

2.7. The Seller undertakes not to disclose the Customer's personal data to third parties other than to the courier service and persons related to them with the purpose to deliver the Product, and when required by the competent Governmental institution in the cases provided for by the laws of the Republic of Lithuania or with a separate written agreement with the Buyer.

3. Buyer's rights and obligations

3.1. Buyer has the right to purchase goods in e- shop according these Rules and other information fields provided in the website.

3.2. The buyer undertakes to accept the ordered goods and pay the agreed price for them.

3.3. If the data provided in the Customer's registration form changes, the Buyer must immediately update them.

3.4. Buyer using e-store agrees with these Buy-Selling Rules and undertakes to comply with them and do not violate the legal acts of the Republic of Lithuania.

4. Seller rights and obligations

4.1. The Seller undertakes to provide all conditions for the Buyer to properly use the e-shop services.

4.2. If the Buyer attempts to harm the Seller's e-store the stability and security of the shop or breach of its obligations, the Seller has the right to immediately and without notice to restrict or suspend the Buyer's access to the e-shop.

4.3. The Seller undertakes to respect the Buyer's privacy right to the Personal Information provided by the Buyer.

4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address indicated by the Buyer.

5. Orders, prices, payment methods

5.1. Buyer are able to purchase 24 hours a day, 7 days a week.

5.2. The Agreement becomes valid from the moment when the Buyer clicks the "Confirm order" button, and upon receipt of the order the Seller confirms it - sends a confirmation letter to the e-mail indicated by the Buyer.

5.3. Price list in the e-shop and in the order form is indicated in EUR, including VAT.

5.4. The buyer undertakes to pay the goods immediately. Only upon receipt of payment for goods the parcel of goods is started to be formed and the delivery term of the goods starts to run.

6. Delivery

6.1.Goods in Lithuania are delivered by sending via LP express courier or registered priority shipment (EUR 5). Delivery time 2-4 business days after the payment is received. Goods are delivered to the EU countries (EUR 10) in 7-10 calendar days, other countries via the registered priority shipment (EUR 15-20) within 14-20 calendar days.

6.2. When choosing a delivery service, the Buyer undertakes to indicate the exact place of delivery of the goods.

6.3. The Buyer undertakes to accept the goods himself. In the event that the Buyer cannot accept the goods himself, and the goods are delivered to the specified address, the Buyer has no right to express Seller's claims regarding the delivery of the goods to the unfit entity.

6.4 The goods are sent to the Buyer within 2 business days, from payment confirmation, the goods are delivered by the Seller or the Seller's authorized representative (courier).

6.5. The Buyer agrees that, in exceptional cases, the presentation of the goods may delay due to unforeseen circumstances beyond Seller's control. In such a case, the Seller undertakes to contact the Buyer immediately and to agree on the conditions for the presentation of the goods.

6.6. In all cases, the Seller is released from liability for violation of the terms of delivery of goods, if the goods are not presented to the Buyer or are not delivered in due time due to the fault of the Buyer or due to circumstances beyond the Seller's control.

6.7. The Buyer must, in all cases, immediately inform the Seller if the consignment is presented in a molded or otherwise damaged package, if the consignment contains unpackaged goods or inappropriate quantities, partly completed goods.

6.8. In any case, the buyer must, at the time of delivery, notice the packaging irregularities, must indicate the remarks in the courier's delivery document or write a separate act for these violations. This Buyer must do with the courier. In the absence of such action, the Seller is released from liability to the Buyer for violations of the goods related to packaging violations not specified by the Buyer in the courier delivery document.

7. Product quality, warranties

7.1. Every item in the e-shop is collectively referred to the product description of each item.

7.2. The seller is not responsible for the fact that the goods in the e-shop may not match the size, shape and color of the goods in their color, shape or other parameters due to the characteristics of the monitor used by the Buyer.

8. Returns

8.1. According to Civil Code of the Republic of Lithuania Article 6.362 the buyer shall be entitled to replacement of the low-quality purchased things within fourteen days from the delivery thereof to the buyer. Please contact us before: info@av17jewellery.com or tel. +370 617 52272

8.2. According to Ministry of the Republic of Lithuania 2014 July 22 resolution 738 approved in ‘Mažmeninės prekybos taisyklės’ (Retail Rules) 17.17.12 pearls, diamonds, precious metals and their products, excluding bijouterie, are non-refundable items. Exception applies if the seller agrees to accept or change the goods.

8.3. If Customer wishes to return disliked good quality item, he/she needs to contact seller within 14 days from the day the customer has received it. Return request has to be written and send to info@av17jewellery.com. The customer has to tell the reason why he/she wishes to return the item and provide with bank account number, in which the money should be returned.

8.4. The following conditions must be met when returning goods to the buyer:

8.4.1. the returned item must be in the original, orderly packaging;

8.4.2. the item cannot be damaged;

8.4.3. the item must not be used, in primary, original appearance (labels are intact, etc.).

8.4.4. the returned item must be of the same composition as the Buyer received;

8.4.5. a document confirming the purchase of the item must be provided;

8.5. The item must be sent by the Buyer by registered mail or by courier to: AV17 Gallery, Totoriu st. 5, 01121 Vilnius, Lithuania.

8.6. Until the item is received by the Seller, it is a customer’s belonging and responsibility. Hence, the customer has to ensure the packaging and preserve the tracking number of the parcel.

8.7. Once the item is received and met 8.4.1.-8.4.5 clauses of these Rules, the Seller arranges the money return within 15 working days.

8.8. All return expenses (post, custom office and etc) are covered by the buyer.

8.9. AV17 gallery reserves its right not to accept items back, if there is a violation of at least one of 8.4.1.-8.4.5. clauses of these Rules.

8.10. All questions and disagreements regarding jewellery return are solved by negotiations. If negotiations are not successful, State Consumer Rights Protection Authority will be asked to help.

9. Buyer and seller liability

9.1. The Buyer is solely responsible for the accuracy of the personal data provided by the Buyer. If the Buyer fails to provide accurate personal data in the registration form, the Seller is not liable for the consequences arising there from and acquires the right to demand direct damages from the Buyer.

9.2. The buyer is responsible for the actions taken using this e-shop.

9.3. The seller is exempted from any liability in cases where the loss arises from the fact that the Buyer, despite the Seller's recommendations and the obligations of the Buyer, did not understand these Rules, although such a possibility was granted to him.

9.4. In case of damage, the damaged Party shall indemnify the other Party for direct losses.

10. Marketing and information

10.1. The seller can initiate for various promotions in e-store.

10.2. The seller has the right to change the terms of the promotions unilaterally, without any notice, and cancel them. Any change or withdrawal of the terms and conditions of the promotions is only valid, i.e. from the moment of their execution.

10.3. The Seller sends all notices by means of the means indicated by the Customer.

10.4. The Buyer sends all messages and questions to Seller's e-store "Contacts" section to the provided phone number and e-mail.

10.5. The Seller is not responsible if the Buyer does not receive sent information or confirmation messages regarding the Internet connection, the network of suppliers of e-mail services, e-mails entering the SPAM folder, or due to incorrect data provided by the Buyer.

10.6 The Customer's personal data may be processed for marketing purposes under the conditions specified in clause 2.4 of these Rules.

11. Final Provisions

11.1 These Rules for the purchase and sale of goods are concluded in accordance with the laws and legal acts of the Republic of Lithuania.

11.2. All disputes arising from the execution of these Rules shall be resolved by negotiation. Failing to reach an agreement, disputes shall be resolved in accordance with the procedure established by laws of the Republic of Lithuania.
